Welcome to Spartan Asphalt & Construction. By accessing our website, requesting an estimate, scheduling services, or doing business with Spartan Asphalt & Construction (“Company,” “we,” “our,” or “us”), you agree to the following Terms & Conditions.
Services
Spartan Asphalt & Construction provides asphalt paving, sealcoating, crack sealing, striping, concrete work, grading, excavation, pavement maintenance, repairs, and related construction services for commercial, residential, HOA, municipal, and industrial customers throughout Utah.
All services are subject to project availability, weather conditions, material availability, site conditions, and scheduling.
Estimates & Proposals
All estimates and proposals provided by Spartan Asphalt & Construction are based on visible site conditions and information available at the time of inspection.
Additional charges may apply for:
- Unforeseen site conditions
- Subgrade failure
- Drainage issues
- Utility conflicts
- Hidden damage
- Additional material requirements
- Customer-requested changes
- Permit requirements
- Traffic control requirements
Estimates are subject to expiration and may be modified due to fluctuations in material pricing, fuel costs, labor costs, or scheduling availability.
Scheduling & Delays
Project schedules are estimated and are subject to change due to:
- Weather conditions
- Equipment breakdowns
- Material shortages
- Permit delays
- Site readiness
- Utility conflicts
- Other circumstances beyond our control
Spartan Asphalt & Construction is not responsible for delays caused by weather, suppliers, subcontractors, acts of God, governmental actions, or unforeseen conditions.
Customer Responsibilities
The customer agrees to:
- Provide clear access to the work area
- Remove vehicles and obstacles prior to service
- Ensure utilities are properly marked when required
- Obtain HOA or property approvals if necessary
- Notify us of underground utilities, sprinklers, septic systems, drainage systems, irrigation lines, or concealed hazards
The customer is responsible for damages caused by failure to disclose underground structures, irrigation systems, utilities, or hazards.
Watering & Irrigation Responsibility
Customers are responsible for ensuring all sprinklers, irrigation systems, water sources, hoses, and runoff are turned off and kept away from newly completed asphalt, sealcoating, striping, concrete, or other surfaces during the curing period as instructed by Spartan Asphalt & Construction.
Spartan Asphalt & Construction is not responsible for damage caused by water exposure, irrigation systems, sprinklers, flooding, runoff, pressure washing, or failure to follow curing and care instructions provided after completion of work.
If newly completed work is damaged, marked, washed away, softened, discolored, eroded, or otherwise affected due to water exposure or failure to follow instructions, the property owner or responsible party shall be fully responsible for all repair, replacement, reapplication, cleanup, labor, material, mobilization, and associated costs required to correct the damage.
Payments
Payment terms will be outlined in the project proposal or invoice.
Unless otherwise stated:
- Deposits may be required prior to scheduling
- Final payment is due upon completion of work
- Late payments may incur additional fees or interest
- The customer agrees to pay all collection costs, attorney fees, lien fees, court costs, and legal expenses associated with unpaid balances
Spartan Asphalt & Construction reserves the right to suspend or delay work for nonpayment.
Asphalt & Concrete Disclaimer
Asphalt and concrete are natural construction materials that may experience:
- Minor cracking
- Surface variations
- Color differences
- Expansion and contraction
- Weather-related wear
- Aggregate visibility
- Minor settling
These conditions are normal and do not constitute defects.
Sealcoating may temporarily track, scuff, or mark during curing depending on weather and traffic conditions.
Warranty Disclaimer
Any warranties provided by Spartan Asphalt & Construction are limited solely to workmanship specifically stated in writing.
Warranty coverage does not apply to:
- Abuse or misuse
- Heavy vehicle damage
- Acts of nature
- Fuel or chemical spills
- Improper drainage
- Subgrade failure
- Ground movement
- Freeze/thaw damage
- Water intrusion
- Sprinkler or irrigation damage
- Normal wear and tear
- Third-party damage
- Lack of maintenance
No verbal statements or representations shall modify warranty terms unless provided in writing.
Limitation of Liability
To the fullest extent permitted by law, Spartan Asphalt & Construction shall not be liable for:
- Indirect damages
- Consequential damages
- Lost profits
- Business interruption
- Property damage beyond the scope of contracted work
- Delays caused by factors outside our control
Total liability for any claim shall not exceed the amount paid for the specific services performed.
Website Use
All website content including logos, images, text, graphics, branding, and marketing materials are the property of Spartan Asphalt & Construction and may not be copied, reproduced, distributed, or reused without written permission.
